The Alberta Court of
Queen’s Bench has decided that the $4,000
cap on auto insurance payouts for soft
tissue claims is unconstitutional. This
will affect Ontario’s auto insurance
system greatly, as now there is no cap on
the amount that they may have to pay out.
With the Alberta ruling, it changes the
provisions that have been set forth in the
auto insurance rules for Ontario as they
have based theirs on the same ideas and
beliefs. This means that their provisions
are unconstitutional as well.
Their Auto Insurance Act will need to be
rewritten to follow the same rules that
the court in Alberta has set forth. The
Alberta government is appealing the
decision, but if they are not successful
it will mean big changes for them. The way
that they calculate auto insurance
premiums will have to be changed, and the
savings that they have been passing on
will not apply any longer.
