Auto Loan for Kentucky Man
Rocky Cisney has never owned the 1992 Ford
that the auto loan people have been trying
to get him to pay for. Yet, they have
taken him to court to get him to settle up
with them, as they say he is responsible
for the auto loan that has not been paid
on. Understandably, Cisney is more than a
little upset with the whole process.
However, his woes have finally come to an
end as a Jefferson County judge has ruled
in his favor that he does not owe the auto
loan and is therefore clear of the debt.
Cisney said that he has been saying all
along that it was not his auto loan debt
to pay back, but that the lender has been
trying to get him to be responsible for
it.
Cisney had a former employee that had
stopped making payments on the truck, and
the auto loan company had attempted to
garnish her wages. However, since she no
longer worked for the company, there were
no wages to garnish. The employee still
owed $9,000 on the auto loan when she
stopped paying.
Cisney got a letter from the auto loan
company saying that he needed to garnish
her wages but ignored it because she
didn’t work there. The auto loan company
then said that Cisney owed them the money
plus the interest rate of 26%, which meant
he owed $60,000 to the auto loan company
even though he had never owned the car.
The court ruled that the auto loan company
took too long in attempting to get the
money and therefore Cisney was not
responsible.
