No Fault
Car Insurance Hurts, Not Helps
Because Michigan is a
No-fault Car insurance State, those that
need to be able to sue cannot. Take the
case of Krysta Gagne. She was hit by a
drunk driver, and sustained injuries that
will plague her the rest of her life. But
when she tried to sue to make up lost
wages, etc. she was not allowed to.
The woman was only 21 at the time and sued
the car insurance company, because he
caused her injuries that she would have to
live with for the rest of her life.
However, the lawsuit was dismissed,
because it is a no fault state. Because
she could not claim that the accident had
changed “the trajectory” of her life, she
could not sue.
The problem is that it did change her
life, but the court of appeals would not
take any of her claims into consideration.
They are appealing, but they will be
looking at a long and costly road to get
her any sort of restitution for her
injuries.
Car insurance is changing however, to make
it easier to sue, but that is a while off
and does not help Gagne now. Meanwhile the
Senate is playing their normal political
wars, and people like Gagne are caught in
the middle while they try to make up their
minds.
