Appeals Court Eliminates PIP Baggage
The
problem with the law these days is that
anyone can seemingly sue anyone else
over absolutely nothing. The courts say
that their dockets are full of people
suing over small items and that it
becomes tiresome to try and wade through
what is a valid claim and what is not.
However, a court in Florida has decided
that they have some control over the
amount of people suing and has rendered
a judgment saying exactly that.
The court was dealing with several
lawsuits as related to auto insurance
and PIP protection on those auto
insurance policies. The courts decided
that a person could not sue their auto
insurance company for not giving them an
explanation of benefits on their
personal injury protection claim. The
judges said that these were “frivolous”
lawsuits that were taking up their time.
The courts will now be cleared of these
lawsuits against the auto insurance
companies. Many applauded the move by
the courts and they said that many times
people sued their auto insurance
companies simply so they could get their
attorney’s fees paid. They are saying
that this will enable them to see which
auto insurance claims are actually due
and payable and which ones are not.
Others said that this was a
misinterpretation of the law at best and
that these citizens had every right
under the law to sue their auto
insurance companies. They said that the
only reason these auto insurance
companies were being sued was because
they were not providing their clients
with the information that they needed –
and refused to do so.
