PA Reviewing Car Insurance

The Pennsylvania Supreme Court has decided to review a recent decision they made regarding auto insurance. Attorneys say that the recent ruling on auto insurance stacking is worthy of review as the way it stands now it will ultimately end up in lawsuits and “financial ramifications” for auto insurance companies.

The case is Sackett vs. Nationwide Mutual Insurance Co., where the court ruled that auto insurance companies must have their clients reject stacked underinsured motorist coverage every time they add another vehicle onto their car insurance policies. They say that in allowing the reargument they were simply making sure that the court’s ruling was practical, and that there would not be issues in the figure with such ruling.

Some of the justices are not happy with the decision to look at it again, as they say that not only has this never happened before, but the court needs to move on to other cases. The fact that the Insurance Commissioner and Nationwide Mutual Insurance Company disagrees with the ruling has no bearing on the outcome.

The courts ruling comes after the trial court rulings that said that the presumption that if stacking on the auto insurance policies is waived once then it is presumed that it is waived for any and all other vehicles as well. However, the Supreme Court disagreed with the ruling because of the possible implications that it would have with commercial vehicles.
