According to the Nova
Scotia Supreme Court, Barbara
Jones-Gordon, a key government advisor,
said that there was no “duping” going on
by the auto insurance industry.
Jones-Gordon resisted pressure from the
lawyer in court on Thursday.
She says that the auto insurance industry
did not misrepresent the facts; instead
they “gave us the information they had at
the time.” She is a senior policy analyst
working on auto insurance issues in 2003 –
the time in question regarding auto
insurance rates.
In 2003, rising auto insurance rates were
of some issue and people wanted to know
why. The premier at the time, John Hamm,
had proposed putting caps on the auto
insurance industry so that they only had
to pay a maximum of $2,500 for pain and
suffering for people with soft-tissue
injuries.
However, there is a lawsuit in the works
now that is trying to get those caps taken
off as they say that the auto insurance
industry claimed it was in a “financial
crisis” at the time when it really wasn’t.
They want the caps removed, and the
legislation declared unconstitutional.
The lawsuit comes about by two Halifax
residents and the Nova Scotia Coalition
Against No-Fault Insurance. They want
people to be able to sue for more money
than they currently can.
